JOSHUA4 ELLIS (Malachi,3 Lt. Matthias,2 Lt. John1), born 22 Dec 1728, died before 21 July 1769.
He married about 1759 INNOCENT HAMMOND (this marriage was recorded in Sandwich, but the date is illegible), born 5 Jan. 1737/8, baptized 30 Aug. 1741 (Vital Records of Rochester), died after 17 March 1797, twin daughter of Samuel and Elizabeth (? Edminster) Hammond of Rochester.
Malachi3 Ellis' will, dated 31 March 1762, names this son Joshua a principal legatee, giving him (jointly with his brother Rowland4) the family homestead and other real estate.
Innocent Ellis, wife of Joshua, was admitted to the Sandwich church, 4 Nov. 1764, and a week later, 11 November, "Mercy & Elizabeth, of Joshua and Innocent Ellis" were baptized as were the younger children in due course.
Rowland Ellis was appointed administrator, 21 July 1769, of the estate of his brother "Joshua Ellis of Sandwich, yeoman, deceased" (Barnstable County Probate, vol. 16, p. 15). The inventory, dated 21 Aug. 1769, totalled some £400. in real property as appraised by Mordecai Ellis, Joshua Blackwell and Solomon Foster (ibid., vol. 13, p. 536). The real estate of Malachi3 Ellis in Sandwich was divided, 30 April 1770, between Rowland Ellis and the heirs of Joshua Ellis (ibid.).
The widow Innocent Ellis married secondly, in Sandwich, 17 Jan. 1773, Gershom4 Tobey, born about 1749, son of Gershom3 and Mary (Foster) Tobey. "Innocent Ellis, now Tobey," appears upon the Sandwich church membership list of 14 April 1787. Proof of the relationships in this family group is furnished by the following deed:
"We, George Ellis of Sandwich, yeornan, and Sabra his wife, in his right, William Nye, Jr., of Sandwich, mariner, and Elizabeth his wife, in her right, Jonathan Nye of Fairfield County, Lincoln, husbandman, and Mercy his wife in her right and Bartlett Nye of sd Fairfield, husband and Deborah his wife in her right, heirs of Joshua Eilis late of Sandwich, yeoman, deceased, for £82. paid by Charles Gibbs of sd Sandwich, mariner," convey certain lots in Sandwich "which fell to us from the above mentioned Joshua Ellis ... free from incumbrance, except only reserving to Innocent Tobey now the wife of Gershom Tobey of sd Sandwich, ... formerly the widow of the above named Joshua Ellis, late of Sandwich, deceased, her right of dower," 7 March 1797; recorded 17 March 1797 (Sandwich Deed Book, vol. 2, p. 193, in Barnstable County Deed Registry).
Gershom and Innocent Tobey, George and Sabra Ellis and William, Jr., and Elizabeth Nye, all of Sandwich, acknowledged this instrument in Barnstable, 17 March 1797. Jonathan and Mercy Nye and Bartlett and Deborah Nye did the same in Lincoln, 29 April 1797 (ibid., p. 194). Joshua married Innocent Hammond, daughter of Samuel Hammond, 2d and Elizabeth Edminster, about 1759 in Sandwich, Barnstable, MA 5,16.,65 (Innocent Hammond was born on 5 Jan 1737/38 in Rochester, Plymouth, MA 5,65,617,643, christened on 30 Aug 1741 in Rochester, Plymouth, MA 65 and died after 17 Mar 1797 in Sandwich, Barnstable, MA 5,65.)
